- Description: Whether you can list a home for short stays in Asheville depends on its zoning, whether you live there full-time, and whether it sits inside the city or in Buncombe County. The rules differ in each case.

You can rent an Asheville home for short stays, but the Asheville short term rental rules limit it through zoning, owner occupancy and stay length. Whole-home rentals face a much harder test, since short-term vacation rentals (STVR) are not allowed in the City of Asheville in most zoning districts [\[1\]](https://www.freestoneproperties.com/blog/buying-asheville-vacation-homes/?ref=josetijam.com). The city of Asheville and unincorporated Buncombe County follow different rules, so your address decides which set applies. Inside city limits, your home must be in a residential zone, and you must live in it full-time to rent part of it [\[2\]](https://www.ashevillenc.gov/department/development-services/compliance-division/homestays-and-short-term-rental-violations/?ref=josetijam.com). These rules have changed recently, so the date of each figure matters. Check the current status of the county hold before you rely on it. Before you list, confirm that your home is in a residential zone and that you live in it full-time [\[2\]](https://www.ashevillenc.gov/department/development-services/compliance-division/homestays-and-short-term-rental-violations/?ref=josetijam.com).

## What is the difference between a homestay and a whole-home rental?

A homestay is a stay of 30 days or less in a home where you live, and it is commonly a room or part of the house. [\[1\]](https://www.freestoneproperties.com/blog/buying-asheville-vacation-homes/?ref=josetijam.com) Asheville's rules treat this differently from renting an entire home you do not live in. [\[3\]](https://www.leisrstays.com/blog/asheville-short-term-rental-regulations/?ref=josetijam.com)

### What counts as a homestay

A homestay keeps you in the home during the stay. Think of a guest in a spare bedroom while you sleep down the hall, or a basement suite in a house you occupy. Both fit the homestay category as long as the stay is short.

### What counts as a whole-home rental

Renting an entire dwelling you do not live in is treated differently under Asheville's rules. [\[3\]](https://www.leisrstays.com/blog/asheville-short-term-rental-regulations/?ref=josetijam.com) If you list a second house that you never occupy, you are not renting part of your residence. You are renting a whole dwelling, and that puts you under a separate set of rules.

The difference is not about price or how many guests arrive. It is about whether you live in the home and what part of it you rent.

### Why the length of stay matters

Stays must be under 30 days for the short-term rental definition to apply. [\[4\]](https://airbtics.com/airbnb-rules-in-asheville-united-states?ref=josetijam.com) A guest booking of three nights in a room of your home is well under that limit, so it fits the short-term definition. A booking of a month or longer does not fit the same way, so set your minimum stay with that line in mind.

### Putting it together

A yes to both points you toward the homestay category. A no to the first question means you are in whole-home territory.

## Which zoning districts allow short-term rentals in Asheville?

Your home must be in a residential zone to be used as a homestay [\[2\]](https://www.ashevillenc.gov/department/development-services/compliance-division/homestays-and-short-term-rental-violations/?ref=josetijam.com). Zoning is the first test, so check it before you spend money on plans or furnishings.

Whole-home rentals face a stricter test. Short-term vacation rentals, where you rent an entire house you do not live in, are not allowed in most City of Asheville zoning districts [\[1\]](https://www.freestoneproperties.com/blog/buying-asheville-vacation-homes/?ref=josetijam.com). A house bought mainly to earn nightly income is therefore a risky purchase in most parts of the city. For a closer look, read [Zoning, caps & distance rules for Austin short-term rentals](https://josetijam.com/austin-str-zoning-caps-distance/).

Consider two houses on the same block. One is in a residential district and the owner lives on site. The other is a whole-home rental with no owner present. The first may qualify as a homestay, while the second may not be allowed at all, even though both look the same from the street.

This is why the listing alone does not settle anything. A rental already advertised online may still sit in a district where whole-home stays are not permitted. The zoning district, not the advertisement, decides what you can legally do with the property.

### Check the zoning of your exact parcel

Check the zoning of your exact parcel before you buy or list the home. Neighboring lots can sit in different districts, so a street name or a nearby rental is not enough to go on.

Use the parcel's street address when you ask the city about its zoning. Keep the district name with your purchase or listing papers. Once you have it, the district tells you which of the two paths above applies to your house.

## Do you have to live in the home full-time?

Yes. If you rent part of your home in Asheville as a homestay, you must live there full-time. The city's official page states the requirement plainly: you must live in the house or apartment full-time [\[2\]](https://www.ashevillenc.gov/department/development-services/compliance-division/homestays-and-short-term-rental-violations/?ref=josetijam.com). Your presence on site is what makes a room rental a homestay under city rules. To go further, see [Average Rent in Asheville, NC: Figures by Bedroom and Source](https://josetijam.com/average-rent-in-asheville-nc/).

Living on site is only one condition. The city also limits how many rooms you can rent out, and the official page sets a room limit of one or more rooms for a homestay in a residential zone [\[2\]](https://www.ashevillenc.gov/department/development-services/compliance-division/homestays-and-short-term-rental-violations/?ref=josetijam.com). Suppose you own a three-bedroom house and live in it. Renting one bedroom to a weekend guest fits within that limit. Renting all three would leave no owner on site, and the rules treat that situation differently.

### Renting a whole home is a separate category

The city's regulations distinguish between renting bedrooms in your full-time residence and renting an entire dwelling [\[3\]](https://www.leisrstays.com/blog/asheville-short-term-rental-regulations/?ref=josetijam.com). The homestay rule covers only the first situation. A whole home rented without an owner living there falls outside that rule [\[2\]](https://www.ashevillenc.gov/department/development-services/compliance-division/homestays-and-short-term-rental-violations/?ref=josetijam.com).

This matters if you plan to buy a second property for guests. A second cabin that you never occupy is a whole-home case, even if you manage the bookings yourself. Owning the property does not make it a homestay, because the full-time living requirement is what qualifies a room rental.

### What this means for your plan

Decide early whether you will live on site or rent the whole home. Your answer determines which rules apply and whether a room rental is an option at all. If you plan to rent every room while you are away, you are working under the whole-home category, not the homestay rule.

## What rules apply outside the city limits in Buncombe County?

Outside Asheville's city limits, Buncombe County sets its own short-term rental rules, and the main one to know is a size cap. Short-term rentals there are limited to a floor area of 9,000 square feet [\[5\]](https://www.wunc.org/2024-01-31/short-term-rentals-in-buncombe-county-frequently-asked-questions?ref=josetijam.com). A house above that size does not qualify, so check the finished floor area before you make an offer.

Floor area is the number that matters here, not the lot size or the number of bedrooms.

### A countywide pause from 2025

In June 2025, the county's countywide restrictions on short-term rentals were put on hold [\[6\]](https://www.bpr.org/bpr-news/2025-06-02/good-news-and-bad-news-for-buncombe-short-term-rental-owners-post-helene?ref=josetijam.com). A pause like this can end or change, so it does not tell you what applies today.

Before you rely on either the size cap or the pause, confirm the current status with Buncombe County. Get the answer in writing before you put money into a purchase planned around a short-term rental.

## What should you do before you list a home?

Start by confirming your parcel's zoning district and whether the address sits inside the city limits. Those two answers decide which set of rules covers the home. Look up the zoning for the exact parcel, not the neighborhood.

Then decide whether you will live on site or rent the whole home. The rules differ for each, so your choice determines which requirements you must meet.

Before you list, open the City of Asheville Development Services compliance page for the current rules. It covers homestays and short-term rental violations [\[2\]](https://www.ashevillenc.gov/department/development-services/compliance-division/homestays-and-short-term-rental-violations/?ref=josetijam.com).

Zoning and your occupancy choice decide whether you can list at all. Start with the parcel lookup, then read the compliance page before you publish a listing.
